TERMS OF SALE

1. Introduction

These terms and conditions (the “Terms and Conditions”) apply to the sale of paintings, drawings, posters, sculptures, or other artwork (the “Artwork”) to you by JERI GRIFFITH (the “Artist”) through the Artist’s website (the Site) at www.jerigriffith.com.

2. Purchases

If you wish to purchase any Artwork made available through the Site (“Purchase”), you may be asked to supply certain information relevant to your Purchase including, without limitation, your credit card number, the expiration date of your credit card, your billing address, and your shipping information.

You represent and warrant that: (i) you have the legal right to use any credit card(s) or other payment method(s) in connection with any Purchase; and that (ii) the information you supply to us is true, correct, and complete.

The Site may employ the use of third-party services for the purpose of facilitating payment and the completion of Purchases. By submitting your information, you grant us the right to provide the information to these third parties subject to our Privacy Policy.

We reserve the right to refuse or cancel your order at any time for reasons including but not limited to: product or service availability, errors in the description or price of the product or service, error in your order or other reasons, and/or to limit the quantity ordered of any items. Moreover, verification of personal or credit card information may be required at any time by the Artist prior to the acceptance of any order.

3. Title and Risk

As soon as the purchase price is paid in full and you have received shipment of the Artwork, you will become the legal owner of the Artwork and, upon such payment, you will be responsible for the Artwork and the risk of damage to or loss of the Artwork will pass to you.

4. Shipping

Artist will ship Artwork within four business days of purchase. Shipping is free within the continental US. For international shipping or special shipping, see item 6 below.

5. Returns Policy

With the exception of specific situations (see below), all sales are firm and final.

We will provide a reimbursement of the return delivery cost for damaged work. To process the claim, we need proof of the damage for insurance purposes and a receipt for the return delivery cost. We request that you return your damaged package to us using your local postal service.

Any damage to the exterior packaging or to the items inside must be documented with pictures and sent to us via e-mail to jeri_griffith@comcast.net. If your item is lost during shipment, we need to wait until the maximum delivery time has expired before processing any claims.

Credits for the return delivery costs will be made within six weeks of receipt and verification of the merchandise. Credits will be made to the credit card used for the purchase.

6. International Shipping and Customs Charges

For international shipping other than Canada, contact the Artist at jeri_griffith@comcast.net to make arrangements. We reserve the right to refuse shipment of the Artwork to destinations that are considered risky. The Artist does not charge any customs duties on international shipments. If any additional customs charges are incurred during shipment, they are not the Artist’s responsibility. We recommend that you check with your local customs officials or your local post office for further information.

7. Liability

In the event that the Artist is found to be liable toward you, such liability shall be limited to an amount of money equivalent to the price you paid for the products returned. Notwithstanding the preceding, nothing in this section shall be construed as limiting any right you may have as a consumer with respect to one or other of the public policy statutes that may apply to you.

The Artist shall not be responsible for not executing any of its obligations, in whole or in part, toward you, nor for damages or losses you may suffer or that may incur, in the event that the nonexecution is a result of a superior force or circumstances beyond the Artist’s control.

8. Ownership of the Artwork Copyright

8.1  Copyright in the Artwork remains the property of the Artist.

8.2  You may not produce any image of the Artwork and may not, at any time, publish or submit for publication or reproduction any image of the Artwork to any third party, including any internet website for any purpose.

8.3  If you breach any of your obligations under paragraph 7, you agree that:

(a)  the payment of damages will not be a sufficient remedy to compensate us or the Artist for your breach;

(b)  we may, and the Artist may, apply to the court for an order to prevent you from continuing to breach your obligations under these Terms and Conditions; and

(c)  we may, and the Artist may, contact the operator of any internet website on which the Artwork is being offered for sale or on which an image of the Artwork has been placed by you or at your direction, and instruct such operator, on your behalf, to remove any such offer for sale or image from any such internet website.

9. Privacy Policy

We never collect any information about you without your knowledge and consent. Any information you provide to us is strictly private. Your name, address or e-mail is never given or sold to any entity. The Artist reserves the right to maintain a list of purchasers with contact information for Artist’s records only.

These Terms and Conditions shall be governed by and construed in accordance with Vermont law. Disputes arising in connection with this legal notice shall be subject to the exclusive jurisdiction of the Vermont courts.
